VOLUNTEER WAIVER

WAIVER OF LIABILITY AND INDEMNITY AGREEMENT (the “Agreement”)

and Permission to Use Images and Other Content

In consideration of my participation at the Publicolor transformation project (the “Project”)

located at

I,

for myself, my spouse, my children, and/or any minors brought to this Project under my supervision (individually and collectively hereinafter referred to as “Volunteer”), do hereby release and hold harmless Publicolor, Inc., its officers, directors, employees, staff, agents, students, volunteers, funders and/or sponsors (individually and collectively hereinafter referred to as “Publicolor”) as well as United Parcel Service, Inc., an Ohio corporation, Trinity Hudson Holdings LLC, Trinity REIT, Inc., 375 HH, LLC, and Hines Interests Limited Partnership, and each of their parent, subsidiary and affiliated companies, and their respective officers, directors, employees, staff, agents, students, volunteers, funders and/or sponsors (individually and collectively hereinafter referred to as the “UPS and HSP Parties”) from any and all losses and/or liabilities arising out of Volunteer’s participation in the Project to the greatest extent allowed by law, and covenant not to sue Publicolor or the UPS and HSP Parties in connection with the Project.

In order to participate at the Project, Volunteer further covenants and agrees as follows: 

  1. If Volunteer’s actions result in any damage to Publicolor’s equipment or personal items, Volunteer agrees to compensate Publicolor for the reasonable costs of such damage. 

  2. Volunteer authorizes Publicolor to use any interview content, photographs and/or videos taken of Volunteer while at the Project (hereinafter referred to as “Content”) for any purposes now or in the future, in Publicolor’s discretion, including newsletters, social media sites, publicity materials or appeals. Volunteer consents to having their name used in connection with the Content. 

  3. Volunteer agrees to abide by the terms of the “Expectations of Volunteers During Project”  and the “Terms of Volunteer Dismissal” as delineated on page 2 of this Agreement, attached hereto and made a part hereof.

  4. Volunteer covenants that they have not been convicted of any violation of law (other than a traffic violation) and does not have any pending criminal actions against them, including, but not limited to, actions relating to child abuse and/or maltreatment.  

 

Volunteer hereby states that they have read this Agreement, fully understand its terms, and is signing the Agreement freely and voluntarily. 

Expectations of Volunteers During Project

 

  1. Volunteer cannot  be alone with a student or other minor who is not a member of their party, nor may Volunteer wander away from the group.

  2. Volunteer cannot use their participation with Publicolor to promote partisan politics, religious matters, or other affiliations.

  3. Volunteer cannot engage in the following:

    1. Discriminatory or racist statements or behavior

    2. Sexual harassment, including, but not limited to, jokes, innuendos, insults, sexist  remarks,  the display of derogatory or pornographic pictures, leering, touching, or kissing

    3. The use of alcohol, illegal drugs or legal drugs

    4. Any unlawful or inappropriate activity.

  4. Volunteer cannot interact with any student except while at the Project under the supervision of Publicolor staff.

  5. Volunteer must maintain the confidentiality of all personal information to which they may be exposed as a volunteer, including, but not limited to, the names, locations, or images of students they encounter through their work with Publicolor. 

  6. Volunteer must use separate bathrooms, as determined by Publicolor staff, from those used by students.

  7. If Volunteer has any Project-related concerns, including questions about appropriate behavior or complaints regarding inappropriate behavior by students, Publicolor, or another volunteer, Volunteer must speak immediately with a Publicolor staff member at the Project about such concerns. 

 

Volunteer Dismissal

 

Publicolor, in its sole discretion, reserves the right to reassign or dismiss Volunteer for any reason or no reason, with or without notice or cause. Without limiting the forgoing, reasons for dismissal may include but are not limited to: 

 

  1.  Refusal to attend orientation or other required training

  2. Refusal to give suitable references or disclose past convictions for crimes

  3. Excessive lateness

  4. The use of alcohol or other inappropriate substances while at the Project

  5. Involvement in any illegal activities

  6. Failure to adhere to any of Publicolor's policies

  7. Any inappropriate behavior.
